I believe that oskar made it pretty simple. If you are an undead, then you are immune to critical hits.
So yes, Tomcat is correct because undead leave the dust spatter when killed.

that's what get's me, is it just the undead that are immune?
it almost feels like there are other enemies that are...
i could be wrong, obviously.

Demons, ghosts and constructs are immune. There is an undead category, but they are not immune. Constructs is a weird group that includes such things as ash gargoyles, the glowing abcess (and etc), the chaos beasts, the oozes, jellies, and mudfiends, and the various skeletons.

So that's more than originally affected when oskar decided to nerf criticals. Probably because of the growing "construct" roster.
