Looking at the code I noticed that the chance to get away with no skill points in evasion is 20%.
with 4 points in evasion someone could do a hit run technique that would allow them to attack, flee, run in for another attack. This would be especially effective against enemies who don't move like most bosses. Against all others it would still allow them to typically attack without getting attacked.

Am I correct in my assumption? (My java is vary week so I could be reading the code wrong).

It's not an exploit, it's the way it's meant to be.
IIRC, with level 4, you can flee anytime, and with level 5, mobs won't initiate the battle (except when they run into you, and they don't move diagonally).
Hit and run tactics is already a popular way to defeat strong mobs, even with no skill point in evasion.

Level 5? The information I have (which could be wrong, since I got it from a forum post) is that there is a base 15% chance that a monster on an adjacent square will attack, even if it does not attempt to move onto your square. So with Ev3 there is no chance this will happen. A monster can't move on a diagonal, but if you are standing adjacent to a monster on the diagonal I'm not sure whether that 15% base chance still applies.

yeah, there are only 4 levels of evasion possible. not sure about the percentages...
